El sistema binominal vigente en Chile, constituye uno de los cerrojos que impiden la modificación
sustantiva de la Constitución Nacional de 1980 heredada del gobierno de facto de Augusto
Pinochet. El escenario preelectoral 2013 presentó una fuerte demanda por una Nueva
Constitución y constituyó una de las promesas de campaña de la recientemente electa presidente
de Chile, Michelle Bachelet. La mandataria presentó en 2014 un proyecto de reforma
electoral, que pretende modificar el sistema binominal, junto a otras reformas, abriendo la
puerta a la posibilidad de sentar las bases para una futura reforma Constitucional. El presente
trabajo tiene como objetivo analizar el sistema binominal y sus implicancias en vistas al debate
en torno a la Reforma Constitucional en Chile.
Chile´s Constitution is considered to be one of the most significant inheritances of the dictatorship of Augusto Pinochet. The electoral agenda of 2013 election had under the spotlight the demand of a Constitutional reform. As a result of that, one of the main campaign promises of the elected president Michel Bachelet was a New Constitution. In 2014, president Bachelet presented an electoral reform project of the binomial system which is considered to be a historical opportunity to lay the foundations for a future reform of the Constitution. Therefore, this article is aimed to analyse the executive proposal in regard to the effects on the institutional system and the possibility of a future new legitimate Constitution.
